- Highlight the penalty charges on all of the account statements for the full 6 years.
- Add them all up to give you a total.

What Happens Once I Send A Claim?

- Once we send your card provider the claim amount, they usually respond in one of two ways:

- Reject the claim.
- Offer a full or part settlement.

If you’re happy with the settlement, the claim ends here, if you’re not – it goes to court.

Does The Claim Always Go To Court?

Usually, if the claim is small, the card-provider often wants to settle quickly to avoid costs but if the claim is large, it is more likely the lender will do nothing. What If My Statements Go Back Further Than Six Years?

If your card was taken out over 6 years ago you may not have all of your statements to hand, in this case you can submit an estimated claim. This is an appropriate course of action if you genuinely believe you have been unfairly charged during a ’statementless’ period. To achieve an estimated claim, charges are calculated from available statements and the amount is duplicated to cover the entire time of card ownership.

What Costs Are Involved?

The Data Protection Act Disclosure request is made under the Data Protection Acts (DPA) 1984 and 1998.
